Booking Terms


In this contract, ’I’, ’me’ and ’my’ mean Sam Jobi Media (the photographer), and ’you’ and ’your’ mean the person or persons named on the invoice (the client). ’The shoot’ means the photography session described in the invoice. By paying the booking retainer you confirm that you have read, understood and agreed to these terms.


1. Scope of Work: You and I will arrive at the agreed time and location, which I’ll confirm with you seven days before the shoot. The products, inclusions and fees are set out in the invoice.


2. Retainer and payment: When you sign and pay the retainer, I’ll reserve the time and date for you exclusively and won’t take another booking for that slot. The retainer is 50% of the total fee and is non-refundable. The balance, together with any agreed travel costs, must be paid at least seven days before the shoot. I won’t release any images until full payment has cleared, and if any payment is later dishonoured I’ll hold images back until a replacement payment has cleared.


3. Work Product: All photographs are captured in digital format. I’ll deliver the final images through a private online gallery within six weeks of the shoot, as high-resolution JPEGs available for download. RAW files are not provided. The online gallery stays open for fourteen days from delivery, so please download and back up your images during that window.


4. Rescheduling / Late Arrivals: 

4.1 — If you need to reschedule because of illness, an emergency, an act of God or any other cause outside your control, your retainer will be carried over to the new date.

4.2 — Any other request to reschedule is at my discretion.

4.3 — A £75 rescheduling fee is payable when you ask to reschedule, and I’ll only confirm the new date once that fee has been received.

4.4 — The rescheduled session must take place within two weeks of the original date, unless we agree a longer period in writing.


5. Cancellation: If you cancel with less than seven days’ notice before the shoot, the retainer is forfeit and is not transferable to another date. If you cancel with more than seven days’ notice, your retainer can be applied to a future booking within twelve months, subject to my availability.


6. Indemnification: 

6.1 — You confirm that every person being photographed has given their permission to be included in the shoot.

6.2 — You’ll let me know in advance of anyone who needs special handling, and of any health or accessibility considerations that might affect the session.

6.3 — I’ll do everything I reasonably can to deliver the shoot as agreed. If circumstances beyond my reasonable control prevent me from doing so, clause 12 (Force Majeure) applies.

6.4 — If I’m unable to attend due to illness, injury or another unavoidable reason, I’ll do my best to arrange a suitable replacement photographer or, if that isn’t possible, refund all fees you’ve paid.

6.5 — Photography sessions can be physically demanding. You take part at your own risk and agree to follow my reasonable instructions during the shoot.

6.6 — I’m not required to keep copies of your images more than fourteen days after the online gallery is delivered. Please download and back up your images within that window.

6.7 — You agree to indemnify me and hold me harmless against any personal injury that occurs during or immediately around the shoot, except where caused by my negligence.

6.8 — You agree to indemnify me and keep me harmless against all losses, claims, proceedings, damages, costs and expenses (including reasonable legal costs on an indemnity basis) arising from any breach by you of this contract.

6.9 — I have full discretion over which photographic materials I release to you.

6.10 — The final post-production, editing style, effects and overall look of the images are at my discretion.

6.11 — I reserve the right to end the session and leave the location of the shoot if I, my assistant, or my equipment is subjected to abusive, threatening or unsafe behaviour. In that case no refund will be due.


7. Timeline and Schedule: 

7.1 — You agree to confirm the schedule with me one week before the shoot. Any later changes to the schedule or location must be notified in good time, and I must confirm receipt before they take effect.

7.2 — On the day of the shoot, you agree to provide me and my assistant with meals at the same time as the wedding party (where the shoot is a wedding).


8. Permissions and permits: You’re responsible for obtaining any permissions or permits I need to photograph at the location — for example, from venues, churches, reception spaces, building managers or landowners. I’m not obliged to arrange these on your behalf.


9. Exclusive Photographer: You agree that no one other than me and my assistant may take pictures of any poses, lighting set-ups or arrangements I create during the shoot.


10. Copyright and Model Release: 

10.1 — I own the copyright in all images I create, and I have the exclusive right to reproduce them — including for marketing, portfolio, sample products, editorial use, and display on or within my website and studio. You release me from any claims or liability arising from such use, including in relation to blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or not.

10.2 — Where the images include a child or children, you confirm that as parent or guardian you give permission for those images to be used and published by me, including for the purposes set out in clause 10.1.

10.3 — If I want to use your images commercially to promote a business other than my own, I’ll obtain your written permission first.


11. Data Protection (GDPR): 

11.1 — I’m the data controller for the personal data you give me under this contract (such as names, contact details, venue and supplier information) and I process it in line with the UK GDPR and the Data Protection Act 2018.

11.2 — I use your personal data only to deliver the services you’ve booked, to communicate with you, to meet my legal and tax obligations, and — where you’ve given me separate consent — for the marketing and portfolio uses set out in clause 10.

11.3 — I keep your personal data for no longer than is necessary, and in any case no more than seven years after final delivery, except where the law requires a longer retention period (for example, accounting records).

11.4 — You have the right to access, rectify, restrict, port or request erasure of your personal data, and to withdraw any consent you’ve given, by writing to me. You can also raise concerns with the Information Commissioner’s Office (ico.org.uk).

11.5 — I store image files containing personal data on encrypted, password-protected systems and reputable cloud services. If a qualifying personal data breach occurs, I’ll notify you and the ICO without undue delay.


12. Force Majeure: 

12.1 — Neither of us is liable for any failure or delay in performing our obligations under this contract if caused by events beyond our reasonable control, including (but not limited to) acts of God, severe weather, fire, flood, war, terrorism, civil unrest, epidemic or pandemic, government restrictions, or the failure of utility or transport infrastructure.

12.2 — If a force majeure event prevents me from attending or completing the shoot, we’ll both make reasonable efforts to agree an alternative date, and any fees you’ve already paid will be credited towards it.

12.3 — If we can’t reasonably agree an alternative date within twelve months of the original date, either of us may end this contract. In that case I’ll refund all fees you’ve paid except the booking retainer and any reasonable costs I’ve already incurred (such as travel, accommodation or supplier deposits).


13. Limitation of Liability: 

13.1 — Nothing in this contract limits or excludes either party’s liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

13.2 — Subject to clause 13.1, my total liability to you arising under or in connection with this contract — whether in contract, tort (including negligence), breach of statutory duty or otherwise — is limited to the total fees you’ve paid me under this contract.

13.3 — I’m not liable for indirect or consequential losses, including loss of profit, loss of opportunity, or distress caused by circumstances outside my reasonable control.

13.4 — In the unlikely event that some or all images are lost, damaged or destroyed before delivery for reasons within my control, my liability is limited to a refund of the fees you’ve paid in proportion to the images affected.


14. Album & Product Delivery: 

14.1 — Where you’ve ordered an album or other physical product, I’ll send you a digital design proof within two weeks of you confirming your final image selection.

14.2 — You’re entitled to one round of revisions to the album design at no additional charge. Any further revisions may be chargeable at my standard hourly rate.

14.3 — Once you’ve signed off the design in writing, I’ll place the order with my print partner. Production and delivery typically take up to one month from sign-off, but are not guaranteed and may be affected by the supplier’s lead times.

14.4 — Risk in any physical product passes to you on delivery. Title passes once full payment for the product has been received.


15. Governing Law, Complaints & Disputes: 

15.1 — This contract and any dispute or claim arising out of or in connection with it (including non-contractual disputes) is governed by the laws of England and Wales.

15.2 — Both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.

15.3 — If you have any concerns about the service I’ve provided, please raise them with me in writing first. I’ll acknowledge any complaint within seven days and aim to give you a substantive response within twenty-eight days.

15.4 — Before issuing legal proceedings, both parties agree to attempt to resolve any dispute in good faith through direct discussion and, if necessary, through mediation with a recognised mediation provider.


16. Social Media and Personal Use License: In return for the payment you make under this contract, I grant you a perpetual non-exclusive licence to print or reproduce the images you download from the gallery or that I deliver to you, on the following terms:

16.1 — You may share the web or high-res photos I deliver on your personal and business social media accounts, provided you credit or tag me in every post.

16.2 — This licence doesn’t permit you to screenshot low-quality previews, edit or alter the photos in any way, or do anything else that would infringe my moral rights.

16.3 — You may print the photos I deliver, or that you download from the gallery, for your personal use only, and:

a: you must not sell, license, sub-license, transfer or otherwise distribute the printed photos;

b: you must not use the printed photos for advertising or commercial purposes; and

c: you must not submit or enter the photos into any competition.


17. Pricing & Additional Products: Any services or products not included in this initial contract will be charged at the price current when you place the order. All prices are subject to change at any time without notice. Credit vouchers have no cash value and can only be applied towards products or services purchased.
